This warranty shall remain in effect for as long as such original purchaser owns the vehicle on which they were originally installed. During this time, any claim alleging that any product fails to conform to the foregoing warranty may be made only by the customer who purchased such product and only while such customer owns such product. This warranty is non-transferable. This warranty has no cash value. FCS will exchange/replace any and all products which have met the provisions below and have been deemed defective by either FCS or an authorized dealer. This warranty does not apply to products which: 1. Have been modified or disassembled 2. Have been improperly applied 3. Have been installed on vehicles used for commercial or racing purposes, or any other non-cataloged applications 4. Have been subjected to use outside of normal operating conditions 5. Show signs of regular use and wear, but are not defective Costs incurred for removal of defective products or installation of replacements are not covered by this warranty, nor are any other damages (either incidental or consequential), regardless of when failure occurs. Return and Inspection Procedure: End users must return suspected/alleged defective FCS products to the authorized FCS dealer wherein the original sale occurred. End users must supply a date, proof of purchase receipt, and reason for claim. Dealers/Suppliers of FCS products will verify that End User claims meet FCS warranty requirements and are identified as FCS parts. FCS Dealers/Suppliers should fill out and submit the FCS Return Material Authorization (RMA) Form per the instructions on the RMA form. FCS will review the form and, upon approval, will issue an RMA number and provide return shipping instructions. Assignment: Customer may not assign his/her rights or obligations hereunder without the express prior written consent of FCS Automotive International. Conditions: This sale is subject to the terms and conditions stated herein, which are in lieu of and replace any and all terms and conditions set forth in any documents issued by customer, including, without limitation, purchase orders and specifications.
